X Factor Competition – Co-op

1.1 The prize draw for a chance to win one of 6 pairs of tickets to the X Factor Final will run from 00:01 UK Time on 12 October 2016 to 23:59 UK Time on 30 November 2016 (the "Closing Time") inclusive.
1.2 All prize draw entries must be received by the Promoter no later than the Closing Time. All prize draw entries received after the Closing Time will be automatically disqualified.
1.3 Purchase of any Finish product (each an Eligible Product) from a Co-Op store is necessary. Original proof of purchase must be retained to validate any entry.
1.4 To enter the prize draw, please text “WINTICKETS” to 88440 by the Closing Time. Texts will be charged at your standard network rate.

2.1 Entrants have the possibility of winning a pair of tickets to an X Factor Live Final show (6 pairs available).
Winners will not have the right to request a cash alternative for any of the prizes.
2.2 All of the prizes are non-negotiable and non-transferable. Prizes are awarded "as is" with no warranty or guarantee, either expressed or implied by the Promoter, FremantleMedia Limited, Syco Entertainment Limited or any of their associated companies. All prize details are at the Promoter’s sole discretion. Any costs and expenses associated with prize acceptance and use not specified herein as being provided are each winner’s sole responsibility, including any and all taxes.
2.3 The Promoter reserves the right to provide alternative prizes of equal or greater value (determined by the Promoter in its sole and absolute discretion) in the event of unforeseen circumstances. The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this prize draw in the event of any unforeseen circumstances or technical reason outside its reasonable control, the Promoter bars sole responsibility for supply of the prize and Co-Op cannot be held responsible for any claims relating to the prizes.

X Factor Live Final Tickets
2.4 The X Factor Live Final runs on Saturday 10th December and Sunday 11th December. Winners of X Factor Live Final Tickets will be notified of which day they have won Tickets for.  No alternative dates can be chosen by the winner.  If the winner is unable to attend on the date of the tickets awarded to him or her, the Promoter reserves the right to pick another winner at random. 
2.5 Winners of The X Factor Final tickets will receive an e-confirmation at least 5 days prior to The X Factor Live Final. Each winner must attend The X Factor Live Final venue at a time allotted on the day of the event to trade their e-confirmation for physical tickets. Failure to do so will result in that winner’s tickets being forfeited.
2.6 Winners of tickets to an X Factor Live Final show will be required to make their own way to the venue. These prizes do not include the costs of travel, food and drink, spending money, tax, personal expenses or any other costs incurred in addition to those set out above. Expenses that are incidental to the fulfilment of the prize are the responsibility of the winners.
2.7 Winners will be responsible for their own behaviour as well as the behaviour of their guest whilst taking the Prize. The Promoter reserves the right in its absolute discretion to exclude the winner and/or guest from participation in the Prize if any party fails to comply with the directions of the Promoter, the terms and conditions of The X Factor Live show venue or any companies associated with the Prize or the winner and/or guest act in a manner that is dangerous to themselves or to the public or is anti-social in any manner or which causes a disturbance or nuisance to others.’
2.8 The X Factor Final tickets are intended for the named winner and the resale of tickets is strictly prohibited. The named winners, along with their guest, must collect their tickets in person at the venue on the day of the relevant X Factor Live show and must present photographic ID matching the name on their e-confirmation.  Once the tickets have been collected the winner will be solely responsible for them. The Promoter will not accept liability for any loss, theft or damage to these tickets.  Separate Terms and Conditions from the production company, and partnering third party, along with a venue ticket disclaimer will apply.

3.1 All winners will be chosen at random on 2nd December 2016 (the Draw Date) with only one prize available to each entrant.
3.2 The decision of the Promoter will be final and no correspondence or discussion will be entered into.
3.3 RMI will contact winners by phone-call using the telephone number detailed in their prize draw entry by the following times and provide them with an email address to confirm acceptance of their prize. Winners of tickets to an X Factor Live Final within 1 (one) day of the Draw Date.
3.4 To confirm acceptance of any prize awarded, winners must email their full name and proof of purchase of the relevant Finish product from a Co-op store to the email address provided by RMI within 3 (three) days of receiving their notification text of winning a prize.  Original proof of purchase must be dated and timed before the date on which entrants entered the prize draw. Non-receipt of a winner’s claim is wholly the responsibility of winner. Winners should keep a photocopy of their receipt for their own records. Illegible, damaged, mislaid or defaced claims will not be accepted.
3.5 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 3 (three) days of being notified of their win, the Promoter reserves the right to offer the prize to another winner selected at random.
3.6 In the event a claim for a prize is not received by the Promoter within 3 (three) days from receiving your notification text of winning a prize, the Promoter reserves the right to both withdraw prize entitlement and re-draw the prize.
3.7 The prize may not be claimed by a third party on your behalf.
3.8 The Promoter does not accept any responsibility if you are not able to take up the prize.

4.1 The prize draw is open to residents of Great Britain (for the avoidance of doubt, it is not open to residents of Northern Ireland) aged 18 years or over except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the prize draw or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
4.2 In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the prize draw.
4.3 The Promoter will not accept prize draw entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(d) incomplete.
4.4  The Promoter will further not accept proof of transmission as proof of receipt of entry to the prize draw.
4.5 There is a limit of five entries per person and one entry per Eligible Product. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Only one mobile number per person will be accepted. Only one prize can be won per person.
4.6 The Promoter reserves the right to verify all winners, and such verification shall include but not limited to the submission of the original proof of purchase. Should the Promoter have any reason to believe that there has been a breach of the entry requirements or these terms and conditions, including, but not limited to, any tampering with the entry process, the Promoter may at its sole discretion refuse to process a win claim and refuse to award a prize or withdraw prize entitlement and disqualify you from further participation in the promotion.
4.7 The Promoter reserves all rights to disqualify any entrants whose conduct is contrary to the spirit or intention of this prize draw.

5.1 Insofar as is permitted by law, neither the Promoter nor its agents, partners or distributors, including the Co-operative Group Limited, FremantleMedia Limited and Syco Entertainment Limited will in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of such party, its agents or distributors or that of their employees. Your statutory rights are not affected.
5.2 In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
5.3 The Promoter reserves the right exercisable at any time in its sole discretion, to terminate, amend or extend this promotion or to provide alternative prizes of equal or greater value of those listed above.

6.1 The Promoter reserves the right to publish the names and counties of residence of the winners. All winners must, at the Promoter’s request, participate in any promotional activity (such as publicity and photography) surrounding the winning of the prizes, free of charge, and they consent to the Promoter using their names and images in promotional material for up to one year after the competition closes.
6.2 RMI will send the name and county of the winners to anyone who writes within two months of the Closing Time enclosing a self-addressed envelope to Retail Marketing International at 2 Exmoor Street, London, W10 6BD.
6.3 By entering the prize draw, you agree that any personal information provided by you with the prize draw entry may be transferred to, held and used by the Promoter, RMI, FremantleMedia Limited, Syco Entertainment Limited and their agents and suppliers to administer the prize draw, distribute any prizes won and for the circulation of the winners name and counties.

7.1 By submitting a prize draw entry, entrants agree to be bound by these terms and conditions.
7.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.
7.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
